CONDITIONS FOR THE CORRECT USE OF THE DOCSENDING.COM PLATFORM

The Customer undertakes not to use software and services of the DocSending.com file sharing platform for illegal purposes or for the transmission or exchange of illegal, harassing, libelous or defamatory material, harmful to the privacy of others, abusive, threatening, harmful, profane , vulgar, obscene, inaccurate, false, misleading, misrepresenting, of which it does not own the rights, misleading or that infringes, or may infringe intellectual or industrial property rights or other services of third parties; that causes harassment, disturbance, violence, pedophilia, exploitation or harm, in any way, that may promote racism, violence or hatred is directed to an individual or a group and is based on sex, creed, national origin, religious affiliation, sexual orientation, language or other characteristic of that individual or group, for the exchange of viruses, chain letters, or for the unsolicited and mass distribution of e-mails (spamming) also references to the regulations in the State from which it operates or that of the recipient

DocSending.com expects all users to comply with the Terms and Conditions of Use on the Home Page of the website www.docsending.com.

In the event that DocSending.com detects or receives notification of illegal files or content distributed through its service, we will follow the procedures described in the Terms and Conditions document and in this Removal Policy statement.

By using our website or file transfer service, you agree to be bound by our Disclosure Notice and Policy below.

REGARDING THE REPORTS

Reports of any kind, also made through our contact form on the website www.docsending.com must include at least the following information:

1) Contact details, function name, organization, address, email address of the notifier;

2) All information necessary for DocSending.com to evaluate the lawfulness of the contested content, including its location (URL);

3) Reason relating to the illegitimacy of the content or the reason why it conflicts with the Terms and Conditions, Cookie Policy, Privacy Policy, Removal Policy, state or community laws

4) Reason why DocSending.com is the most appropriate intermediary to address the issue.

Any security vulnerabilities within the DocSending.com platform must always be reported to us via the contact form on the website.

EVALUATION OF REPORTS

DocSending.com will evaluate the reports by dividing them into 2 categories:

1) Illegal / punishable content reported by law enforcement or unequivocally illegal and / or punishable content reported by sources other than law enforcement

2) All other content that does not fall into the categories listed in point 1

ACTIONS

In the event that DocSending.com determines that the content in question is unequivocally illegal or punishable, category 1, the content in question will be immediately removed;

In the event that DocSending.com determines that the content in question is not illegal or punishable, such as category 2, the content in question will not be removed.

In the event that DocSending.com is unable or not sufficiently able to judge whether the content in question is unequivocally illegal or punishable, docsending.com will inform the user reported for having abused the report by requesting the same or to agree with whoever reported the abuse or allow DocSending.com to remove the content. In case of no agreement between the parties, whoever made the report may contact the police and issue a formal complaint.

TIMES:

In the case of the report referred to in points 1 and 2 we reserve the right to remove the clearly illegal content "within 48 hours of notification. If the legality / illegality is not evident, it may take longer, for example, in the case of a request for intervention by users who have uploaded the contents, who made the report, intervention of external or legal consultants.The documents will in any case be removed from our platform within 7 days of publication.

HOW WE EVALUATE THE REPORTED CONTENT

With regard to the evaluation of which files are considered illegal, we refer to what is reported in the document "Terms and Conditions", as required by Italian law, and to the type of crimes envisaged and listed in the law for the protection of rights on social networks ( NetzDG) ​​entered into force in Germany on 1 October 2017.

With reference to the illegal contents provided for by the above, the following crimes can be highlighted:

MEASURES TO NOTIFY THE COMPLAINANT AND THE USER UPLOADING THE CONTENT

Upon receipt of a report of abuse, the author of the request will receive an email confirming receipt. Once the complaint has been examined, we will send the author of the request an e-mail to inform him of our decision and the related reasons (for example, on the fact of removing or blocking the contents in question as illegal and / or in violation of our Terms and Conditions, or that the contents do not violate them, any law or guideline and therefore no action will be taken). If the content is blocked, we will also send the user who uploaded the document a notice with information regarding the removal. The notice also contains additional information in an attempt to inform the user who uploaded the DocSending.com Terms of Service document or applicable law, so that in the future they will no longer upload any documents in violation of the rules.

In the event of repeated abuse or serious violations, we may penalize you by disabling certain features or deleting your account. In most cases, the first violation of our DocSending.com User Rules will result in a warning. The general rule is that the account is closed after three warnings, but we may decide to close an account on the first infringement, in case of serious violations. In case we realize that you have removed content by mistake, we will restore it.
